Terms and conditions

1. Legal notice
This website, accessible at thinkhx.com, and the service it provides are operated by THINKHX _(company legal name, registration number and registered office pending confirmation)_. The publication director is _(pending)_. The website is hosted by _(hosting provider pending)_.
2. Acceptance and scope
These terms govern access to and use of THINKHX and the online service it provides. By creating an account and/or using the service, the user acknowledges having read and accepted these terms. They are made available on the website, where they can be consulted directly, and are provided on request by any means. If the user does not accept them, they must not use the service.
3. The service
THINKHX is an all-in-one platform where you create AI assistants, configure them, publish them in your own catalog, run them in seconds, and track usage and costs — all from one place. It is provided as an online service accessed through the website (thinkhx.com). Descriptions and illustrations on the site are given for information and are not contractual.
The user remains responsible for their own means of access (internet connection, equipment, up-to-date and secure browser) and for any cost charged by their own providers.
4. Account registration
Using the service requires creating a personal account. Access requires an email address and a secret, personal and confidential password. The user is solely responsible for keeping these credentials confidential and for all activity carried out under their account, except in case of proven fraud, and must notify us without delay of any loss, misuse or fraudulent use.
On registration the user undertakes to provide true, accurate and up-to-date information, to keep it current, and not to publish or transmit any unlawful, objectionable or harmful content. Registration is strictly personal. We may refuse or close an account in case of breach of these terms.
5. Access and availability
We strive to keep the service available and working correctly. However, the characteristics of the internet do not allow us to guarantee uninterrupted, error-free operation. Access may be suspended temporarily for maintenance, updates or technical improvements. We may also modify or discontinue all or part of the service.
6. Subscription and payment
Where the service, or part of it, is paid, the applicable price and billing terms are shown before the user commits, in the user's local currency. Any paid order carries an obligation to pay. Payment is processed through the secure servers of our payment partners; payment-card details do not transit through our own systems and are protected by encryption. Access to the paid service is opened once the payment is accepted.
7. Acceptable use
The user undertakes not to misuse the service, and in particular not to: attempt to disrupt or compromise its security or availability; access data or accounts that are not theirs; use the service for any unlawful purpose; or publish or transmit unlawful, harmful or infringing content. We may suspend or terminate access, without notice, for any breach of this section, at the user's exclusive fault.
8. Intellectual property
THINKHX is the sole owner of all elements of the site and the service (texts, images, videos, logos, designs, software, trademarks, visual identity, databases, structure and any other intellectual-property element), protected by applicable law. No element may be reproduced, copied, distributed, represented, stored, used or exploited, in whole or in part, without our prior express written authorisation. The user is granted only a personal, non-exclusive, non-transferable right to use the service for its intended purpose.
9. Liability and warranties
We cannot be held liable for non-performance due to the user, to force majeure, or to an unforeseeable and insurmountable act of a third party. The service is provided on a best-effort basis; we do not warrant that it will be free of interruption or error. We are not liable for the use the user makes of the service in breach of these terms, nor for indirect damage arising from such use.
10. Personal data
For details on how personal data is collected and used, please read our privacy policy, available at any time on the website.
11. Links to third-party sites
The service may contain links to third-party sites, provided for convenience only. Following them takes the user off THINKHX, at their own risk and subject to the third parties' own terms.
12. Term and termination
These terms apply for as long as the user uses the service. The user may stop using the service and close their account at any time. We may suspend or terminate access in case of breach of these terms. On termination, the right to use the service ends; provisions that by their nature survive (intellectual property, liability, governing law) remain in force.
13. Changes to the service and these terms
We may modify the service and these terms at any time. The user should therefore review these terms before each use. The terms applicable are those in force on the day of use. We are not liable to the user or any third party for any modification, suspension or discontinuation of the service.
14. Governing law
These terms are governed by, interpreted and applied in accordance with _(applicable law and jurisdiction pending confirmation)_. If any provision is held void, the remaining provisions keep full effect; our failure to invoke a breach is not a waiver of the right to invoke it later.
15. Contact
